When you've got an american citizen on american soil who's commited an everyday crime that's one thing, and we should go to every length the protect his constitutional rights. But when you're in a situation where national security is at risk (ie you've caught the guy who's perfectly willing to blow up some american civilians and call it the work of god) the situation is very different and calls for a different set of action. When vital information is on the line and american lives are at stake, what does it matter if we break out the electrodes and the rack? These people were perfectly willing to harm us, so why get all soft? We should let our government do whatever the heck they want to these prisoners as long as it means I can sleep better at night knowing terrorists are behind bars. If they hate freedom and democracy so much let's show them just what disregarding the constitution gets them.

protecting American "Constitutional rights" you say? Those aren't just American rights. The idea of the bill of rights are that they are part of the inalienable rights of being a human. Every person on American soil has the right to speech and petition and privacy that we all have.
I agree that in some cases we might need to take the kid gloves off, but making that the rule instead of the exception is just the thing we have been working to destroy throughout history. Remember the league of nations? the Kellog-Brian pact? the United Nations? Geneva Conventions? Alot of kids I know make fun of them daily, hell I do sometimes, because they didn't(/don't) "accomplish" anything, but it's what they stand for. They're an effort by the international community to stop disgusting things like war and torture.
It's not about claiming the moral highground, but about actually having it. Every time we torture a terrorist or miss with a "smart bomb" and blow up a wedding, this "crazy idea" that the terrorists have that we're this evil imperialist western nation becomes truer and truer.

Basically, because not all of them are guilty.
That said, I agree with basically everything you just said. Again, my only problem is that they're not all guilty.
